The EU Protection of Human Rights – a Unique System in the Unique Times (What it is and What it Could Be)

Abstract

The Union’s protection of human rights is often associated entirely with the Charter of the Fundamental Rights of the EU. In fact, the protection of the rights of the individual is provided by the sophisticated combination of various mechanisms of the different nature. Each of these mechanisms is characterized by its own peculiarities and certain limits. Their mutual interconnection and balanced interaction create a unique system of human rights regulation at the level of the EU. The aim of this contribution is to analyse the nature and weak points of these mechanisms including: Mechanism of the Charter of the Fundamental Rights of the EU, the Common European Values, Judicial Doctrine of Fundamental Rights, Certain instruments of soft law character. The objective is to outline the eventual ways of their future eligible regulation, which will enable to eliminate (at least partly) the mentioned pitfalls.
