Providing Loans to Consumers through Peer-to-peer Lending in the Context of Directive (EU) 2023/2225 of the European Parliament and of the Council of 18 October 2023 on Credit Agreements for Consumers

Abstract

This paper focuses on the examination of the peer-to-peer lending areas defined with regard to the new Directive (EU) 2023/2225 of the European Parliament and of the Council of 18 October 2023 on credit agreements for consumers and repealing Directive 2008/48/EC and the original draft Consumer Credit Directive 2021/0171 with regards to the Slovak Republic specificities in the area of peer-to-peer lenging. Furtherhore this paper presents the results of the analysis of peer-to-peer lending in the Slovak Republic based on the absence of studies assessing peer-to-peer lending legislative regulations in individual countries, in terms of i) the nature of peer-to-peer lending in the Slovak Republic from the perspective of peer-to-peer lending entities in the Slovak Republic, ii) the strictness of legislative regulation of peer-to-peer lending on the financial market in the Slovak Republic, iii) the corporate nature of companies providing peer-to-peer lending services, iv) the controversial aspects of peer-to-peer lending in the context of the decision-making practice of courts.
