The Legal Foundations of New Economic Models for Planetary Well-Being

Professor Morgera’s keynote address highlights the need to develop new economic models that are capable of achieving planetary well-being. This brief response highlights the need for analysis of law’s role in constituting both the problematic economic models that have contributed to and facilitated our climate crisis, as well as transformative opportunities to found the new models Morgera calls for. In short, it is a plea to keep focus on law’s constitutive role and opportunities for interventions that seek to expose and re-think how law mediates our relationship with the climate.
