Abstract
Het recht op toegang tot overheidsinformatie is een fundamenteel recht voor burgers: zonder informatie is het onmogelijk om de overheid te controleren. Ondanks het fundamentele karakter van dit ‘grondrecht’ op overheidsinformatie blijkt de uitoefening hiervan in de praktijk behoorlijk weerbarstig. Het gevolg hiervan is dat burgers ook in hun informatiepositie kwetsbaar kunnen zijn tegenover de overheid. Deze bijdrage verkent specifieke verschijningsvormen van bestuurlijke kwetsbaarheid binnen het recht op toegang tot overheidsinformatie en (het gebrek aan) juridische reacties hierop.
Abstract
The right to access government information is a fundamental right for citizens: without information, it is impossible to scrutinize the government. Despite the fundamental nature of this ‘right’ to government information, its exercise in practice proves to be quite challenging. As a result, citizens can also be vulnerable in their information position vis-à-vis the government. This contribution explores specific manifestations of administrative vulnerability within the right to access government information and (the lack of) legal responses to it.
