Exclusionary Rule of Illegal Evidence Under China’s Criminal Procedure Law and Recommendations for Vietnam

Abstract
The exclusion of evidence aims to protect individuals from illegal evidence-collection activities of competent authorities, thereby protecting their legitimate rights and interests. In the judicial reform in recent years in China, the exclusion of evidence has gained great attention from experts, lawmakers, and authorities. This paper explores the process of making and developing the Chinese criminal procedure law on evidence exclusion. On that basis, the author compares and proposes recommendations to enhance Vietnamese criminal procedure law on relevant issues.
