Extended Producer Responsibility – Building The Legal Framework in Vietnamese Law on Environmental Protection From International Experience

Abstract

This paper analyses the extended responsibilities of producers (EPR) in Vietnam from a legal perspective. It uses a normative legal methodology to systemise the existing laws and regulations addressing the EPR system since 2005. The results show that EPR provisions in the new Vietnam Law on Environmental Protection 2020 require producers and importers of particular products and packaging to take responsibility for their products after use. Policy instruments in Vietnamese legislation are popular and applied in other countries worldwide. Therefore, implementing these laws in Vietnam will also face similar legal challenges as those commonly found in other developed and developing countries.
