Abstract
This article addresses the COVID-19 pandemic and its impact on disabled persons’ human rights particularly in light of triage regulations. The German triage law is analyzed according to the legal framework of the Convention on the Rights of Persons with Disabilities (CRPD), that is, based on the human rights model of disability. The human rights model is characterized as improving international human rights law. It is based on inclusive autonomy and inclusive equality. It is argued that the German triage law fails to meet the CRPD standard. Its anti-discrimination clause does not fulfill the requirements of inclusive equality and inclusive autonomy.
